Waste and circular economy

An electronic register and traceability of every shipment

Ley 7/2022 replaced the paper chronological file with an electronic register of prescribed content, and requires documenting every shipment and checking that the operator is authorised for that specific EWC code.

An electronic waste register, in the prescribed content and format, kept for at least five years.
RD 553/2020
An identification document and prior notification for each waste shipment, with the operator and destination verified.

Applying the waste hierarchy: prevention, preparing for reuse, recycling, other recovery and, as a last resort, disposal.
RD 1055/2022
Extended producer responsibility for packaging: an annual declaration, membership of a collective scheme, and the corresponding eco-contribution.
Penalty regime

Very serious infringements of Ley 7/2022: €100,001 to €3,500,000, with possible closure and a ban on public contracting.

Frequently asked questions

What we get asked about Waste

Does the register have to be electronic?

Yes. Art. 65 of Ley 7/2022 set an electronic format with prescribed content, replacing the previous chronological file.

What gets checked about an operator?

That its authorisation is current and that it covers the specific EWC code of the waste shipped, not just the generic activity.

How long must the paperwork be kept?

At least five years, and for shipment documents also the acknowledgement of receipt at destination.
