Due diligence under the EU Deforestation Regulation (EU) 2023/1115

Regulation (EU) 2023/1115 makes market access in Europe for seven commodities conditional on a due diligence statement with coordinates for every production plot and proof of no deforestation after 31 December 2020.

Art. 3 Regulation (EU) 2023/1115
Products may only be placed on the market if they are deforestation-free, were produced in line with the country's law, and are covered by a due diligence statement.

Mandatory information: description, quantity, country of production and geolocation coordinates of every plot where the commodities were produced.
Art. 10 Regulation (EU) 2023/1115
A risk assessment against set criteria, including forest presence, prevalence of deforestation and the reliability of the information.

Filing the due diligence statement in the information system before placing on the market or exporting.
Penalty regime

A fine of at least 4% of annual EU turnover, confiscation of the goods and of the revenue, and temporary exclusion from public procurement (art. 25).

What we get asked about EUDR

Which commodities are covered?

Cocoa, coffee, soy, palm oil, timber, rubber and cattle, together with the derived products listed in Annex I.

Is a single coordinate point enough?

Plots over 4 hectares require a polygon. Below that a point may suffice, unless the risk assessment says otherwise.

How do you evidence the absence of deforestation?

By checking each plot's geometry against satellite imagery and forest loss sources relative to the 31 December 2020 cut-off.
